Kiddies Day Out - Terms and Conditions

These Terms of Service ("Terms") govern your access to and use of the Kiddies Day Out website. By accessing or using Kiddies Day Out, you agree to be bound by these Terms, our Privacy and Cookie Policy. Our service

Kiddies Day Out helps you discover days out, classes and shops. To do that, we show you venues, shops and classes we think will be relevant to you based on your onsite and offsite activity and location. To provide our Service, we need to be able to identify you and your location. We do this by asking for your addresses once registered. Some of the things we show you are promoted by advertisers and venue managers. As part of our service, we try to ensure that even promoted content is relevant to you. You can identify promoted content because it will be clearly labelled.

Your content

Kiddies Day Out allows you to post content, including photos, comments, links, addresses, events, products, services, clubs, classes and other venue related information. Anything that you post or otherwise make available on Kiddies Day Out is referred to as "User Content". You retain all rights in, and are solely responsible for, the User Content you post to Kiddies Day Out. You agree that you will not submit any User Content protected by copyright, trademark, patent, trade secret, moral right, or other intellectual property, personal, contractual, proprietary or other right owned by a third party without the express permission of the owner of the respective right. You are solely liable for any damage resulting from your failure to obtain such permission or from any other harm resulting from User Content that you submit. You represent, warrant, and covenant that you will not submit any User Content that impersonates another or is unlawful, threatening, abusive, libelous, defamatory, invasive of privacy or publicity rights, obscene, harassing or otherwise objectionable. We rely on you to present us with User Content that contains accurate and factual material to the best of your knowledge. We assume no responsibility for the accuracy of information provided on Kiddies Day Out.

You grant Kiddies Day Out and our users a non-exclusive, royalty-free, transferable, sublicensable, worldwide licence to use, store, display, reproduce, save, modify, create derivative works, perform and distribute your User Content on Kiddies Day Out solely for the purposes of operating, developing, providing and using Kiddies Day Out. Nothing in these Terms restricts other legal rights Kiddies Day Out may have to User Content, for example under other licences. We reserve the right to remove or modify User Content, or change the way it’s used in Kiddies Day Out, for any reason. This includes User Content that we believe violates these Terms.

Following termination or deactivation of your account we may keep your User Content without reference to the 'User' for an indefinite time. Kiddies Day Out and its users may retain and continue to use, store, display, reproduce, save, modify, create derivative works, perform and distribute any of your User Content that other users have stored or shared on Kiddies Day Out.

If you choose to submit comments, ideas or feedback, you agree that we are free to use them without any restriction or compensation to you. By accepting your submission, Kiddies Day Out doesn’t waive any rights to use similar or related feedback previously known to Kiddies Day Out, or developed by its employees, or obtained from sources other than you.

Security

While we work to protect the security of your content and account, Kiddies Day Out can’t guarantee that third parties won’t gain access to our system. We ask that you keep your password secure. Please notify us immediately of any compromise or unauthorised use of your account.

Third-party links, sites and services

Kiddies Day Out may contain links to third-party websites, advertisers, services, special offers, or other events or activities that are not owned or controlled by Kiddies Day Out. We don’t endorse or assume any responsibility for any such third-party sites, information, materials, products or services. If you access any third-party websites or services from Kiddies Day Out, you do so at your own risk and you agree that Kiddies Day Out has no liability arising from your use of or access to any third-party websites, services or content.

Termination

Kiddies Day Out may terminate or suspend your right to access or use Kiddies Day Out for any reason with appropriate notice. We may terminate or suspend your access immediately and without notice if we have a good reason, including any violation of any of our Terms and conditions.

Subscriptions

Kiddies Day Out offers monthly and annual subscriptions. We reserve the right to vary the features and types of service we make available to different categories of users at any time.

We will try our utmost to process your subscription promptly but we don't guarantee your subscription will be activated by any specified time. Our contract with you to provide subscription services will be formed, and your access to subscription services will start, when we have successfully verified your payment and contact details.

Subscriptions Eligibility

To products, classes or venues on Kiddies Day Out you agree that you are at least 18 years of age.

You also agree that you have never been convicted of a felony and/or are not required to register as a sex offender with any government entity.

If you are listing an activity on Kiddies Day Out including Classes, kids clubs, kids activities you should obtain a DBS check.

By using Kiddies Day Out you agree that you have the relevant insurance and liability cover.

Renewal

Unless specifically stated in an offer or promotion when you place your subscription order with us, and unless Kiddies Day Out decides to revoke your subscription (for example if you are banned from the site), you agree that at the end of the initial subscription period (and of each renewal period thereafter), your subscription will automatically renew for the same subscription period at the then prevailing renewal rate, which may change from time to time. You may cancel your subscription at any time as set out below.

Cancellation

You have the right to cancel your subscription at any time. If you cancel, you will continue to have access to your subscription until the end of the current subscription term. Payment already taken cannot be reimbursed.

You can cancel your subscription by completing the 'cancel my subscription' action at kiddiesdayout.com/subscription or by notifying Kiddies Day Out customer support at hello@kiddiesdayout.com.

Kiddies Day Out reserves the right to cancel individuals' subscriptions at any time and for any reason. If your membership of the site and/or subscription is terminated by Kiddies Day Out due to a breach of these terms or our site's wider T&Cs, you will not be entitled to receive a refund of payments already taken. Any scheduled payments will be cancelled and further payments not taken. You will continue to be responsible for any fees or other charges you have incurred prior to such termination.

Fees and payments

You are responsible for any fees that are payable, including any processing or other fees charged by the issuing bank/payment provider.

The cost of your subscription will be made clear to you on the subscription order pages or otherwise during the order process. It may change from time to time. You agree to pay the fees at the rates notified to you at the time you purchase your subscription, together with any processing or other associated fees charged by the issuing bank/payment provider. Eligibility for any discounts is ascertained at the time you subscribe and cannot be changed during the term of your subscription. We will always inform you in advance of any increase in the price of your subscription and offer you an opportunity to cancel it if you do not wish to pay the new price.

You are responsible for the payment of all charges associated with the use, by you or someone else, of the site and/or a digital application using your ID.

When you purchase a subscription, you must provide us with complete and accurate payment information. By submitting payment details you confirm that you are entitled to use those payment details for this purpose. If we do not receive payment authorisation or any authorisation is subsequently cancelled, we may immediately terminate or suspend your access to your subscription, and in suspicious circumstances, we may contact the issuing bank/payment provider and/or law enforcement authorities or other appropriate third parties.

If your membership of the site or subscription is terminated by Kiddies Day Out due to a breach of these terms or our site's wider T&Cs, you will not be entitled to receive a refund of payments already taken. Any scheduled payments will be cancelled and further payments not taken. You will continue to be responsible for any fees or other charges you have incurred prior to such termination.

Refunds can only be made to the credit/debit/charge card that was used for the original purchase, unless it has expired, in which case we will contact you.

Selling on Kiddies Day Out

Any products placed for sale on Kiddies Day Out do so subject to these terms and conditions.

Kiddies Day Out acts as an arm’s length contractor by providing you with an Internet marketplace. Kiddies Day Out are not publishers, partners or joint ventures and we act solely in the collection of money paid by your buyer for online purchases.

Kiddies Day Out reserves the right to remove any products from the site following valid complaints from our customers.

By using Kiddies Day Out you agree to indemnify us against any claim by any person, including reasonable costs and lawyers fees in regards to any Product. You will also agree to not knowingly place any Product for sale which is not of merchandisable quality.

If for whatever reason you are unable to continue selling a product you agree to remove it immediately from Kiddies Day Out to avoid complaints from the customers. You also agree to not replace any listings which have been removed for whatever reason by Kiddies Day Out.

We shell send you a message by email at time of the order is placed, this will provide all information of the order. You will also be able to access all orders within your console. You agree to comply with all the stages set out on your listing. If you fail to deliver the product or service then a dispute might be raised between you and the seller.

Delivery

You agree to post, deliver or offer collection by the dates stated when setting up the order or agreed between you and the seller after the order has been placed.

You agree to notify the customer on the date of dispatch by updating their order in your console. If the customer notifies you of any non-delivery you will investigate immediately and keep contact with the customer to inform them of your progress. If for whatever reason the customer has not received your product within the time frame, you agree to refund the money paid, including any delivery charges via the payment type it was received.

Payments

All online payments are done through Stripe and are created between you and the seller. Kiddies Day Out takes no commission on any orders placed via the website. All disputes are between you as the seller and the buyer and can be resolved within the Stripe dashboard. If using online payment you agree to pay all fee’s which are applied by Stripe and can be found here: https://stripe.com/gb/pricing

Offline payments are created between you and the buyer. Kiddies Day Out does not accept any liability for any offline transactions and any disputes, contact and organising of collection / delivery will be done between you as the seller and the buyer.

Advertising

You agree for us to advertise any products, shops, classes, venues on our social media platforms, email and any offline marketing that we produce.
